White House Announces Pilot Program for H-1B Stateside Renewals

The White House has given the approval for a pilot program allowing a limited number of foreign nationals who are in the United States on H-1B nonimmigrant visas to renew their visas without having to leave the country.

The United States Department of State indicated that the pilot program, RIN 1400-AF27 will include an initial 20,000 participants and will begin in January, 2024. More details and eligibility concerning the pilot program will be announced when a notice is published in the Federal Register.

The stateside H-1B nonimmigrant visa renewal program is one of a number of measures that the federal government has been pursuing to lower waiting times for consular processing. Foreign workers who are in the U.S. on an H-1B status are engaged in specialty occupations which have a three-year duration. The majority of H-1B nonimmigrant visa holders are those employed in the tech industry and must schedule an appointment at a U.S. Embassy or Consulate before they are allowed to return to the United States after traveling abroad.

It is hoped by many that such a program can be expanded to include other nonimmigrants in the U.S. in other nonimmigrant visa categories to further lower waiting times for visa applicants and reduce lengthy and expensive travel abroad merely to obtain a new visa.
