American Immigration Lawyers Association (“AILA”) members, of whom Enterline lawyers are also members, have reported that the United States Citizenship and Immigration Services (“USCIS”) has begun issuing five-year Advance Parole documents to applicants valid for five years. This is apparently for individuals who are now eligible for five-year Employment Authorization Documents (“EADs”) under guidance issued by USCIS on September 27, 2023.
The extended validity Advance Parole documents have been issued as both combined on the EAD cards and as a separate Advance Parole documentation, as appropriate. Although no USCIS guidance has been published, AILA members are confirming that USCIS began issuing these extended validity Advance Parole documents in an apparent effort to reduce the number of times an applicant may need to submit Form I-131.
This is great news for all foreign nationals who are in the U.S. with valid EAD and Advance Parole documentation to ease their burden while waiting for the USCIS to make a final decision on their applied for status. We appreciate USCIS taking these extra steps to ease the immigration journey.
